When Bill Sorrell was Secretary of Administration, he caused a meeting of the Judicial Panel of judges to review and increase the Motor Vehicle fine schedule. Sorrell brought with him several members of the Administration, as well as members of the House and Senate. That meeting was unconstitutional due to the Separation of Powers clause, Chapter II, Section 5 ("The Legislative, Executive, and Judiciary departments, shall be separate and distinct, so that neither exercise the powers properly belonging to the others.")
The purpose of a fine schedule is deterrence from unsafe driving practices. Safety was never mentioned in this meeting, but income was mentioned at least seventeen times. In the end, fines were raised from 100% to 600%. The current fine structure is unconstitutional because all revenue bills are supposed to begin in the House of Representatives, Chapter II Section 6 "…That all revenue bills shall originate in the House of Representatives…"
In addition, the legislature, in it's infinite wisdom, changed the law so that municipalities got a large chunk of ordinance violations. All of a sudden, virtually all of the cops in the state went from "Protect and Serve" to "Harass and Extort".
As Attorney General, Bill Sorrell refused to investigate evidence I brought to him concerning a Police Officer writing tickets for offenses which never occurred.
When you see a Police cruiser, do you feel safe and protected, or do you feel threatened?
We used to know better than to mix law enforcement and income.
